Terms of Service

1. Definitions

“Service” refers to the ShotCrafted platform, including the website, application, AI generation tools, and all related features.

“User,” “you,” “your” refers to any individual or entity that accesses or uses the Service.

“Content” refers to any images, text, data, or other material uploaded to or generated through the Service.

“Uploaded Content” refers to images or other material you submit to the Service.

“Generated Content” refers to images or other material produced by the Service using AI.

“Credits” or “Tokens” refers to the digital units purchased or granted that are consumed when generating images through the Service.

“We,” “us,” “our” refers to Finsho Limited, trading as ShotCrafted.

2. Eligibility

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

The Service is available worldwide, though we make no representation that the Service is appropriate or available for use in all jurisdictions. You are responsible for compliance with any local laws applicable to your use of the Service.

3. Account Registration and Security

3.1 Account Creation

To use the Service, you must create an account using a valid email address and password, or through a supported third party authentication provider (such as Google OAuth). Account authentication is managed through our authentication provider, Clerk.

3.2 Account Responsibility

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at ronan@shotcrafted.com if you become aware of any unauthorised use of your account.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information when creating your account and to update such information as necessary.

4. The Service

4.1 Description

ShotCrafted is an AI powered platform that enables users to upload jewellery product images and generate lifestyle photography using artificial intelligence. Users upload a product image, select a style or scene, and the AI generates a lifestyle photograph featuring the product.

4.2 No Guarantee of Output Quality

The Service relies on artificial intelligence models to generate images. We do not and cannot guarantee the quality, accuracy, realism, or suitability of any Generated Content. AI outputs are inherently variable and unpredictable. By using the Service, you acknowledge and accept that:

• Generated images may not meet your expectations in every instance.
• Results may vary depending on the quality of your Uploaded Content, the scene selected, and the nature of the product.
• We have no direct control over the specific output produced by the AI model for any given generation.
• You are not entitled to a refund or credit if you are dissatisfied with the quality or appearance of a generated image. Once a credit is consumed to initiate a generation, that credit is spent regardless of the outcome.

4.3 Service Availability

We aim to provide a reliable and consistent service but do not guarantee uninterrupted or error free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from downtime or service interruptions.

5. Credits and Payment

5.1 Credit System

The Service operates on a credit (token) based system. Each image generation consumes one or more credits depending on the generation type. Credits can be purchased through the Service in the credit packs displayed on the pricing page at the time of purchase.

5.2 Free Credits

New users may receive a limited number of free credits upon registration. Free credits are subject to the same terms as purchased credits and may be subject to additional conditions at our discretion.

5.3 Credit Expiry

Purchased credits do not expire. They remain in your account until used.

5.4 Payment Processing

All payments are processed securely through Stripe. By making a purchase, you also agree to Stripe's terms of service. We do not store your full payment card details on our servers.

5.5 Pricing

Prices for credit packs are displayed on the Service at the time of purchase and are quoted in the currency shown. We reserve the right to change pricing at any time. Any price changes will not affect credits already purchased.

5.6 No Refunds

All credit purchases are final and non refundable, except where required by applicable law (including but not limited to EU consumer protection regulations). Once a credit is used to generate an image, it is consumed and cannot be reversed, refunded, or credited back to your account, regardless of the output quality.

6. Intellectual Property and Content Ownership

6.1 Your Uploaded Content

You retain full ownership of any images and content you upload to the Service. By uploading content, you grant Finsho Limited a worldwide, non exclusive, royalty free, perpetual, irrevocable licence to use, reproduce, modify, adapt, process, and store your Uploaded Content for the following purposes:

• Providing and operating the Service (including AI processing and image generation)
• Training, improving, and developing current and future AI models
• Marketing, promotional, and advertising purposes
• Internal research and development

6.2 Generated Content

You are granted a worldwide, non exclusive, royalty free, perpetual licence to use, reproduce, distribute, display, and commercially exploit any Generated Content produced through your use of the Service. You may use Generated Content for commercial purposes including but not limited to product listings, advertising, social media, websites, and print materials.

Finsho Limited also retains a worldwide, non exclusive, royalty free, perpetual, irrevocable licence over all Generated Content for the following purposes:

• Training, improving, and developing current and future AI models
• Marketing, promotional, and advertising purposes
• Internal research, analysis, and development
• Display on the ShotCrafted platform or related channels

6.3 No Exclusivity

The licences granted to you in respect of Generated Content are non exclusive. Similar or identical outputs may be generated for other users. We do not guarantee the uniqueness of any Generated Content.

6.4 Finsho Limited IP

All rights, title, and interest in the Service itself, including its software, design, branding, AI models, algorithms, and underlying technology, remain the exclusive property of Finsho Limited. Nothing in these Terms grants you any rights to our intellectual property beyond the licences expressly stated.

7. Acceptable Use

7.1 Lawful Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws and regulations, including but not limited to those of the European Union and the United Kingdom.

7.2 Prohibited Content and Conduct

You agree that you will not upload, generate, or use the Service to produce content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
• Contains or depicts explicit, pornographic, or sexually exploitative material
• Infringes upon the intellectual property rights, trademarks, or proprietary rights of any third party
• Depicts or promotes counterfeit goods, replica products, or goods that infringe on any brand or trademark
• Is fraudulent, deceptive, or misleading
• Promotes violence, discrimination, hatred, or harm against any individual or group
• Contains malware, viruses, or any harmful code
• Violates any applicable export control or sanctions laws
• Otherwise violates any applicable local, national, or international law or regulation

7.3 Your Responsibility for Content

You are solely and fully responsible for:

• All content you upload to the Service, including ensuring you have the legal right to use and upload such content
• All use you make of Generated Content, including ensuring that your use complies with applicable laws and does not infringe on the rights of any third party
• Any consequences arising from the upload, generation, distribution, or commercial use of content through the Service

We are not responsible or liable for any Uploaded Content or Generated Content, nor for how you choose to use such content. You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your content or your use of the Service.

8. Account Suspension and Termination

8.1 Suspension or Termination by Us

We reserve the right to suspend, restrict, or terminate your account and access to the Service at any time, with or without notice, for any of the following reasons:

• Violation of these Terms or any applicable law
• Uploading or generating prohibited content as described in Section 7
• Fraudulent, abusive, or suspicious activity on your account
• Use of the Service in a manner that could damage, disable, or impair the Service or interfere with other users
• Attempts to reverse engineer, copy, or exploit the Service or its underlying technology
• Non payment or payment disputes
• Any other conduct that we reasonably determine to be harmful to the Service, its users, or Finsho Limited

8.2 Effect of Termination

Upon termination of your account:

• Your right to access the Service ceases immediately
• Any unused credits in your account are forfeited and are non refundable, except where required by applicable law
• We may retain or delete your Uploaded Content and Generated Content at our discretion
• The licences you granted to us under Section 6 shall survive termination

8.3 Termination by You

You may close your account at any time by contacting us at ronan@shotcrafted.com. Account closure does not entitle you to a refund of any purchased credits.

9. Disclaimers

9.1 Service Provided “As Is”

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by applicable law, we disclaim all warranties including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non infringement
• Warranties that the Service will be uninterrupted, secure, or error free
• Warranties regarding the accuracy, reliability, or quality of any Generated Content

9.2 AI Limitations

You acknowledge that AI generated content may contain inaccuracies, artefacts, distortions, or imperfections. We do not warrant that Generated Content will be free from errors, suitable for any particular purpose, or of any particular standard of quality.

10. Limitation of Liability

10.1 To the maximum extent permitted by applicable law, Finsho Limited, its directors, employees, agents, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or business opportunity
• Damages arising from your use of or inability to use the Service
• Damages arising from any Generated Content or Uploaded Content
• Damages arising from unauthorised access to your account

10.2 To the maximum extent permitted by applicable law, our total aggregate liability to you for any and all claims arising out of or related to these Terms or the Service shall not exceed the total amount you have paid to Finsho Limited in the twelve (12) months immediately preceding the event giving rise to the claim.

10.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Finsho Limited, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your Uploaded Content or your use of Generated Content
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your infringement of any third party rights, including intellectual property rights
• Any claim by a third party related to content you uploaded, generated, or distributed through the Service

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

13. Modifications to the Service and Terms

13.1 Changes to the Service

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13.2 Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the “Last Updated” date at the top of this document and, where appropriate, notify you via email or through the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

14. Third Party Services

The Service may integrate with or rely on third party services, including but not limited to Stripe for payment processing and Clerk for authentication. Your use of such third party services is subject to their respective terms and privacy policies. We are not responsible for the actions, content, or policies of any third party service.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.

15.2 Jurisdiction

Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ireland.

15.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable EU or national consumer protection legislation.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

17. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by Finsho Limited to be effective.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Finsho Limited regarding your use of the Service and supersede all prior agreements, communications, and understandings, whether written or oral.
